What’s the deal with discovery deadlines? Does anyone follow them? Sometimes I get a case assigned where disco is well over due on our end. Similarly I never get responses on time from defense? Is this bad practice, I feel like being late on disco is normalized… I am new to civil law

It’s becoming normalized, and especially since the pandemic. I think a lot of people have checked out mentally and just don’t put up the effort to get the responses from their clients. On the defense side, you’re seeing low billing rates, high stress, and burnout. The motivation is disappearing by the day. It’s problematic.

It’s normalized. Clients are unresponsive and uncooperative on both ends. And at the end of the day, if you’re late all OC can do is follow up. You generally can’t file a motion to compel without showing that multiple attempts to follow up were made, and even if the MTC is granted you still will have time to produce the discovery.

I mean....they definitely should be followed but like everyone above said its pretty normal. About once a week I am calling opposing counsel to see if I can get an extension on discovery that I wasn't able to get ahold of the client to answer.

There is lots of companies really taking a hit in the tech space. Is this something that people are nervous about? I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

Anyone know a Connecticut or 2nd circuit case for this rule? I can’t find one to save my life. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

Hi everyone - I'm contemplating an offer from a large PI firm. I'm a little more than halfway through completing my 2nd year of practice, and I'm currently at a small firm with a low salary that's just no longer cutting it.

The offer from the large firm is for a pre-suit position, base salary of $100K - is this salary pretty standard for this kind of position?

I have a dumb question... I have my first jury trial coming up in a few months. It's a 3-day auto accident trial. I'm the plaintiff attorney. My question is, should I have my client present the entire three days, or am I okay to tell them that they're fine to leave after they testify?

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??
