Anybody practicing plaintiff side sexual assault cases? Do you like it? I'm in a general PI job and looking at a form with a big sexual assault practice. Thoughts?

I’ve worked on several such cases and they have been extremely personally satisfying. I would check if the firm has a trauma-informed practice, so that (for example) you can say no if any particular task is too triggering. Self-care, therapy, and taking breaks are very important when doing such cases.

Can you further define a sexual assault case in the civil context?

Are you talking actual assault (v. Harassment)? In the employment context? TVPRA Cases?

Like 3rd party criminal act negligent security?

No... I mean like suing the Catholic Church or Boy Scouts for allowing kids to be molested or suing hotel chains for permitting human trafficking in their facilities.

The former requires a substantial showing of institutional knowledge. I see a lot of people chase these claims to have them soundly defeated on SJ because it doesn’t get there.

The latter is a TVPRA case. Even with recent expansions to the law, it’s an uphill battle to prove. You still encounter the intervening criminal actor issue, and a medley of other threshold issues.

Highly specialized fields, and the plaintiff’s attorneys that do well here are super selective and know it inside and out.

(I’m on the defense side of a lot of these cases).

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Client has received 3 injections and a surgery rec for laser discectomy

Sent 2 policy limits demands. Adjuster offered $60k both times because they don’t see a “causal relationship” without offering us any articulated supporting facts.

The insured is a Radiologist, he appears to own a home valued over $2M.

Is this policy open? Best approach? Thoughts?

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

Any experience working @ Chad Jones law?
I’m currently discontent with my income.
(3rd year. Salary=80k and no performance incentive. I brought in $1.4mm AFTER partners claimed over half of fees on my big cases.)
I see CJL offers an incentive+ base but I’m curious about that structure.
Any good or bad firm culture to speak of?
Is it impossible to actually earn a respectable incentive bonus?
Am I going to have some partner come cut me out of any cases where I might actually make a solid fee?

I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. Anyone know a Connecticut or 2nd circuit case for this rule? I can’t find one to save my life. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.
