In my 20 years of experience I’ve only ever seen a non-compete enforced twice and it was a client lead running a $100MM piece business who ended up taking an executive level client job at a direct competitor with the account they were leading, and an ECD who accepted an offer at a competitive agency in a time when we were in a head to head global pitch with said competitive agency. Non-competes are incredibly hard to enforce if it goes to court so an agency will typically only flex of it’s a person who truly has enough knowledge of the ins and outs of the business strategy to be dangerous or highly visible role that is likely to piss off the client.
For most, going to a competitive agency or client is more likely to result in you getting walked out of the office the day you give notice and they still pay you for those two weeks.
If you’re concerned do as others suggested and just don’t share where you’re going
You likely signed and didn’t realize. Would be surprised if you don’t have one. They are hard to enforce regardless. I’d just resign and not say where you are going. Wait 6 months to update LinkedIn.
Thanks. Do you recall if the terms generally pertains to just working in a similar role for other agencies/clients? What about a pivot to a different aspect of the industry entirely? I don’t think there would be an issue, but it’s frustrating that I can’t find or confirm the language.
