Giving performance reviews, especially to associates that I have tried and tried to help in real time, is one of my least favorite parts of this job.

I never gave them. Unless it was going to be a stellar review for a stellar associate, I’d never give negative reviews. Just “name, rank, and serial number.” Or decline to review at all.

I’ve found sandwiching to be pretty effective. Something to the effect of “associate X is eager to learn but struggles with ABC concept. X’s work ethic is commendable and with more time and experience I’m confident ABC concept will click.” That’s assuming the associate actually does want to learn and does work hard. For truly problematic colleagues, I take Principal’s approach.

Any advice on shifting from association law to commercial real estate in FL?

I've been applying to jobs for months but every position wants at least 2yrs of experience in real estate transactions, usually way more. I'm at 1yr+ doing HOA/condo work but have had no opportunity to do real estate transactions like I expected. Seems like the only way to get the experience is to have nailed a big law gig right out of school and get put into that practice.

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?
