Conflicts checks question: thinking about making a move from small(ish) firm to a larger one. How detailed will a conflicts list need to be? Haven’t switched jobs since law school, so at a little bit of a loss about the whole process!

A client developer group just told me they reached terms to “buy equity in a lease.” From what they’ve told me, if we were setting this up fresh, I’d do a new LLC and easily handle capital contributions, buy-sell, etc. in the new LLC agreement. However, here the partner had a long-term lease on the underlying RE that our group wants to develop as a concept. Lease assignment to new LLC is dicey, but I’m thinking maybe we set up a Mgmt services company to contract w/ the partner-tenant entity?

In CA, if a tenant dies, who paid 1 year of rent upfront BUT there was no rental agreement, does the landlord still have the right to keep the rent or can the executor of the estate claim it back? Thanks!

I've been applying to jobs for months but every position wants at least 2yrs of experience in real estate transactions, usually way more. I'm at 1yr+ doing HOA/condo work but have had no opportunity to do real estate transactions like I expected. Seems like the only way to get the experience is to have nailed a big law gig right out of school and get put into that practice.

When settling with a title company plaintiff on a subrogation claim, have any foreclosure defense counsel received settlements over and above policy limits? What is your typical settlement range? How has settling on your subrogation claim negatively affected your counterclaims against the mortgage lender if at all?

Looking for a bit of insight on how commission or bonus is structured on flat rate residential real estate at Canadian law firms. I was offered a good base salary and I was asked what type of structure I was looking for. I am uncertain as to what is considered standard or what to look for in terms of bonus/commission structure. Do you review the other side’s escrow instructions and provide comments? 4 years in and I’ve never done this. Working for a new partner and she insists on doing so “in case there are competing instructions” but isn’t that the entire point of funding through an escrow agent/title company?
