Has anyone here raised a sexual harassment complaint against a fellow or more senior attorney?

How did it work out for you, what happened? I know how it’s supposed to work, but I’m curious to see how it actually worked.

Have you already retained an attorney who specializes in employment discrimination? I strongly advise seeking counsel *before* raising complaints. The attorney can give you a script for your complaint, and then common retaliation tactics to watch out for. You should have a strategy in mind from the outset.

The attorney can also provide ranges for financial settlements, which could be the equivalent of one year’s salary or 4-5x that amount, depending on the strength of your claims and your jurisdiction.

I raised a sexual harassment complaint when I use to work in a govt setting. Investigation initiated, facts were on my side, person got a pay reduction as a consequence and put on probation, I was moved to a different dept, and when the investigation concluded, I was pushed out. Expect to be pushed out, and don’t fear it, just leave having caused a ripple effect, and go somewhere else. The moment you can accept it, the easier everything will be in terms of going on to the next endeavor.

I’m a women who worked in big law in the south for >10 yrs. I never brought a claim (although there was reason to). Based on the experiences of friends who did, it never ended well for them. They were ostracized, forced out and, in some cases, vilified in the community and there was only one instance where it was clear the guilty partner was disciplined (he was a repeat offender, meaning the firm had previously been named in lawsuits related to his harassment). Very important to seek legal counsel _before_ making the complaint. HR and your firm’s general counsel are there to protect the firm, not you.

How did you handle the situations where you thought there was a basis to bring a claim (I.e., how did you solve your issues without going to hr)?

I was at a large labor and employment firm and made a sexual harassment complaint after a partner touched my butt and asked me to go home with him. The investigation process was awful and broke me. I wish I would’ve gotten an attorney from the outset. I definitely regretted it. Happy to chat more about it if you want to message me.

Got fired after the complaint and investigation and the harasser is still happy in that firm. I sued and the litigation is ongoing.

Despite the facts being in my favour the results of the investigation came out negative. I was already searching and landed an offer at a better firm and quit on my own accord, but if I were naive and had stayed I am sure I would have been pushed out and retaliated against.

My old coworker (amlaw 100 firm) got an attorney, sued, and settled. Got pushed out before suing. I sued on a discrimination claim and settled. Don’t ruin your career and get blacklisted by going public (to court). Settle quietly. Money makers at big law firms will never get removed for something like this.

It probably depends on the claim. Parental leave seems more acceptable. I haven’t seen good press on people who went public on racial discrimination.

A female friend of mine recently received a settlement in a sexual harassment action against her employer during mediation. Upon receiving her (female) attorney’s final bill she was blown away to discover that her attorney charged her almost five times what the attorney estimated she would charge for the mediation.
