As someone who has practiced for over 10 years in Chicago, assistant public defender is absolutely correct. There’s no set time period on how long a case can take. The defendant may also keep asking for continuances so a case can drag out because that usually favors the defense. A judge can out an end to that quickly though and deny further continuances. Time limits don’t usually count because most continuances go “by agreement” which tolls any speedy trial clock.
Depends on a lot of things. I can usually work out minor cases at or before the date of the preliminary hearing. Bigger cases or difficult clients/DA’s can take longer. I’ve seen some take more than a year, with a last minute deal negotiated the day of the trial.
Yeah, PA likes to do things their own way. Some of it works, a lot of it doesn’t.
I'm in CA near the bay area. I'd say our misdemeanors take about 9 months. That's simply because the court calendar is so packed it will be 3 to 4 months between pretrials. Felonies are usually shorter to resolve, around 4 months as we try to resolve all before prelim. It's known here that if you go to prelim and the DA actually has to do some work, you're not getting a misdo deal on a felony.
