It’s means if you get approached by another agency, the agency that asked for a first hold either needs to book you or release you from the hold.
For agency creatives and agency producers there is no AICP or union protection. Holds are basically vapor.
In my long freelance experience being on hold was misleading. Don’t stop looking. The only real time to stop is when you are officially booked. Everything else is fiction
Agree! Which is why I just took another 3 day gig at a good rate while I’m waiting “on hold” for this longer one to start. If it ever does.
^that. And the general rule is they have 24 hours to book or release. Good luck!
1st hold: is when an entity has officially been the first to hold time on your calendar for a prospective project that is still bidding and has yet to award.
2nd hold: is when a separate 2nd entity has requested to hold your time for the same dates as your 1st hold. This is a contingency for you to ensure you have a safety net incase the 1st hold falls thru.
Challenge: this is a process when the 2nd hold is ready to confirm and book your time before the 1st hold has confirmed the dates. The 2H can challenge the 1H which gives the 1H 24 hrs to either confirm your time or release the time so the 2H can book you.
Holds: not an official confirmation or booking bc a project is not awarded or ready to kick off for various reasons
Release: the person holding your time releases the time they held with you and that time has now become accessible to others
Confirm/booking: this is when things get official. Your time is not promised to the entity who confirmed / booked your time. If after confirmation the company decided the project died and needs to release you.. you can charge a cancellation fee. Also if you cancel on confirmed job you can be penalized.
What law says I can charge a cancellation fee? What state? Union? Non-Union?
You should familiarize yourself with the hold and challenge etiquette if you hope to book with major brands and companies.
Sure. I only book with major companies. But Holds aren’t that common for creatives. We’re always on at-will agreements even once we’re booked.
I ask for holds, (first, second, third), when booking actors, editors, animators, etc. And companies place me on holds as well. I get it in an email when the hold is for me and I send it in writing when I’m placing one. It’s a courtesy/honor system but I’ve never had a problem with it.
If i hold an editor/actor/whatever, and no else has, it’s called a first hold. It means someone is first in line.
If someone else expresses interest, they can second hold the same person, (example, voiceover actor). But if they’re ready to record suddenly sooner than I am, they need to CHALLENGE for the actor’s first hold. This means that now the actor or actor’s agent is supposed to call me. Now I have to BOOK or RELEASE. if I book them, then they call the person who requested the hold and say sorry my first hold booked me, (understandable as they were first in line). Otherwise If I release them because I’m not ready to record, (client script approval is delayed), then they can book the other job.
Same applies if I’m the producer on hold. If someone expresses interest in me while I’m already on first hold, I tell them I’m already on hold but they can still choose to second hold me. Then I send an email to my first hold and ask, are you ready to book me, otherwise your hold is being challenged and I’d like to take this other job. If they release me, I circle back to my second hold & tell them I’m free.
One nuance a second hold is not synonymous with a challenge. It’s just a hold until they urgently want to do the job with you and request to place a challenge.
There’s no way to enforce these generally speaking, but it’s pretty industry standard and I’ve never had issues.
