I’m currently on FMLA leave. My firm didn’t assign adequate coverage for my cases and emails and assignments aren’t being handled. Should I step in and start responding to things?

Are they your clients? Unless this is business you brought in/control/get credit for, close Outlook and don’t open it until leave is over. There’s no reason to give it a second thought.

No. I believe your working during protected leave could weaken your FMLA and related legal protections.

I would forward the problems to a supervisor once, and put up an out-of-office message providing the contact info for whoever is covering for you.

If you think there could be ethics violations involved by the firm dropping the ball, I would check with a plaintiff side employment lawyer about how to handle this.

I’d also consider your options for new roles once FMLA is over. Unfortunately if they’re dropping the ball so badly with you on leave, it does not bode well for your return. This shouldn’t reflect poorly on you, but it likely will.

If you’re succeeding on all the right metrics (i.e., leadership loves you, clients love you, you’re participating on pitches, you’ve brought in clients, and you’re set up to inherit a book of business), but you’re still not super into it, being promoted to income partner won’t change things, right?
