I believe they should pay you out for any untaken vacation as well.
Having been through it, my advice is to get a lawyer (as cheaply as possible — if you know anyone through a friend and can pull a favor, that’s best) and negotiate. Don’t sign off on their first offer. You can usually get more, particularly if you have a certain level of seniority, have maintained good standing at the company, and are being let go into an acknowledged difficult job market. If they happened to poach you from your previous job where your employment was stable, that can help too.
If you take this path, your tone and manner during the proceedings is important — be kind, reassure them you will only say good things about the company once this last bit of business is behind you and them, and express gratitude for your time there. Even if you’re really doing it through gritted teeth.
This is the best advice and goes for anyone going through a layoff. Never sign the papers immediately and always consult a lawyer first. Most will work with you on an hourly basis unless there’s a case. You’ll learn a lot along the way.
1 week pay per year of service and hopefully the layoff is at the beginning of a month so you have health insurance for that month. Otherwise it’s COBRA. They might provide resources to help with job placement though the quality of those resources may not be that helpful.
Always ask for more
When I got laid off by ogilvy it was 1 week of salary for each year I’d been there plus paid out unused vacation time (which legally they have to do, unless they’ve switched to “unlimited” vacation since I was there, in which case you’ll get nothing for that). If you have an HSA you keep it, if you have a transit account you have a short window of time to spend the money or you lose it. To get the severance, you have to sign agreeing not to sue, if you’re under 40 they give you about a week to review and sign it or consult with a lawyer if you want, if over 40 then legally they have to give you more time.
I’ll add that for the transit account, load up and buy as many transit cards as you can with your remaining funds before the deadline. You’ll thank yourself later.
