3-4 page detailed demand and reference to future care and future pain and suffering and photos of property damage and injuries, I settled $11.5M last year, so it’s clearly working
To add on to what other people said- even pre-suit, include sample jury verdicts in your same venue with similar facts/injuries in the demand letters. I’ve been told by adjusters it actually helps when they set their reserves
This always annoys me. I gets demands all the time with laundry lists of favorable plainriff's verdicts. I can just as easily send a list of defense verdicts or those where they went with the number suggested by the defense, but those aren't referenced in the demand. There are always outliers. Only reference them if you think they're similar to the case you're making the demand in.
I realize every case is different, but still helpful to understand general approaches. Thanks all
Depends on the injuries but limits on pre-suit. Detail demands are good to paint the picture.
No it’s not. The adjuster still needs the info to value the case. I just settled a case for $500k while in suit by sending multiple detailed demands.
I agree, I used to work on demand writing alone, my supervising attorney would have us demand the entirety of the limits available by detailing in the demand the injuries the client sustained in the accident. A plus for said attorney was adding images of visible injuries that had been gathered during the intake process.
