It's a sport. Short of outright intentful cheating (e.g. Lance Armstrong doping) I've never seen another sport that is so litigious.
For something that's not a racquet/ball sport, F1 spends altogether too much time at courts.
Solve it on the track by the presentation at the end of the race or apply a penalty in the following race.
E.g. Carlos' 5 seconds was too harsh for a non-racing conditions lap. Should've been given a 5 second stop and go or a 5 place penalty applied at the next race especially since all the drivers he affected were unaffected at race restart.
in my opinion, Massa, with the threat of bringing the case to justice, is probably trying to pressure the FIA to cancel the Singapore race and recognize at least both drivers as champions.
it's his right, as the race was clearly rigged and a change in its results would ultimately alter the championship standings.
but...
1) it's highly unlikely that a court procedure would even be considered as it seems that in France (FIA hq) the case would've been already over the limitation period, and the relevance of a potential new event (Bernie's recent comment) is debatable.
2) it's also highly unlikely that the FIA would cede to the pressure, cancel the race and recognize a shared championship title, as the consequences of such a decision would be tremendous at different levels of motorsport. just imagine how many championships in the history of the sport, in numerous countries, in various racing series, would now be subject to reconsideration.
again, it's Massa's right to do so. and I do believe that recognizing him at least with a shared title along with Lewis would be personally just and totally fair to him. but the consequences would be just too heavy and potentially unfair in terms of the sport as a whole.
