HR are NOT your friend, they exist to protect the company
Escalation depends on the power dynamic, who are you up against and what is their overall power in the company. If the man or woman is a big shot in the company, then the company will put them first ahead of you visa or no visa
I personally never had to, but I know someone who was fired due to complaints of bullying. You being on visa doesn’t mean that you can be harassed.
Look at your HR’s policy and reporting mechanism. Collect data and evidence. Legal route implies you are going to sue the company , which can be done. But that needs to be a conversation with a lawyer

I reported our HR once for making us go through 6 "workplace harrssessment " trainings in 4 months. LOL. joke aside Actually listening to those trainings made me angry. I was like who the hell does this with their colleagues. are people in my company are so dumb that they would harass their peers like this. But after 4th training I just reminded myself, this is era where we put "hot content" inside on a freaking coffee jar. So there are dumbwits out there who think harassing their colleagues is ok. We all are paying for the actions of few.
