Does cost of litigation factor into the defense assessment at all? It seems like adjusters don’t have any responsibility to resolve cases and avoid litigation before their attorneys spend thousands of dollars wasting time to defend. More generally, what personal goals are adjusters looking to meet that a plaintiff’s attorney can look to capitalize on?

I work with a classroom of Middle School ED students. One student, who I worked with the year before, has changed alot over the year. Last year (pre COVID), she had a good head on her shoulders and I thought I had good rapor with her. But over that period of isolation, she tried to commit suicide.

All year, she was much more withdrawn and ALWAYS on her phone! At the end of the I was 'beat up by her - she really knocked my glasses off.

How should I approach her in the upcoming year?

Do most firms start reporting years in September or January? Prior firm did an August year for counting hours and then another did January (both Amlaw 200). Looking at an Amlaw 100 to lateral in the fall (so trying to anticipate how much of the year I’ll have). I’ll ask what bonus/reporting year but just curious if most follow the same.

Looking for an entry level non exempt positions. I've been in and out of both food service and retail for years. I know what I'm worth and I know how strong my work ethic is. I do not enjoy having carrots dangling out of reach, preventing me from furthering my career. Seems all this 20 something year olds are getting what I feel I do deserve (no ego). New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

Hi everyone - I'm contemplating an offer from a large PI firm. I'm a little more than halfway through completing my 2nd year of practice, and I'm currently at a small firm with a low salary that's just no longer cutting it.

The offer from the large firm is for a pre-suit position, base salary of $100K - is this salary pretty standard for this kind of position?

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

What % of settlements do you take home as an associate? Trying to gauge what I should be seeking in my next contract. Currently at 3% split prorated with all handling attys. Is this normal?

Sent 2 policy limits demands. Adjuster offered $60k both times because they don’t see a “causal relationship” without offering us any articulated supporting facts.

The insured is a Radiologist, he appears to own a home valued over $2M.

Is this policy open? Best approach? Thoughts?

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

How much support staff is reasonable to expect? Plaintiff PI, med mal/aviation and we’ve lost 2/4 “paralegals” in the last month. Lack of support staff really beginning to feel like it will limit my ability to handle the usual caseload. Was on an island before, and only going to get worse…
