Gratuity laws dictate 5 years of continuous service. A year is deemed complete if more than half a year is complete. If you have worked for 220 days in your 5th year then your 5 years are completed and you shall be eligible.
Forget about 190 days, 240 days. That’s number of days taken into account for completed years for calculation purposes and that’s not your concern right now.
Ideally you shall receive gratuity. Drop them mail with the Gratuity act details. Also mention if gratuity is not released then will submit complaint to labour ministry or concerned ministry. I hope you have experience letter l, joining letter, relieving letter. If not get these first and then try to get gratuity

I also left HCL after 4 years 220 days and didn't receive gratuity.
6 years back when i left Infosys after spending 4years n 6 months i got gratuity.

Same I am facing now. I am having 4 years 210 days and HR told like you are not eligible for gratuity so I lost my gratuity .Due to layoff they forced me to drop paper yesterday with some compensation.

Check your internal policy again, may be there is some catch. Ideally you should get your Gratuity.

@TechMahindra is Indian company, so there is no way they can say their policies differ from India government policies.
That's correct l, I got gratuity in 4 year 8 months. Also one of my friend got it in 4 year 6 months who guided me.
