I know this is a long shot, but anyone ever had success getting Snapchats as part of discovery? If so, how did you go about it (forensic analysis of the phone, subpoena, etc.)? TIA!

No, but I’ve succeeded in stopping defendants from getting them 😆

My friend was a paralegal at Snapchat who mostly responded to subpoenas all day

I don’t know all of what’s involved, but they generally ended up turning over evidence of child pornography and stuff like that

I’ve heard of prosecutors getting them for criminal cases through subpoenas to Snapchat. but never for civil cases. If I recall correctly, the prosecutors had to time the subpoenas because SnapChat dumps the data fairly frequently.

A forensic analysis of the phone probably wouldn’t get you everything you’re lookin for. Snapchats disappear by design. At that point, only Snapchat will have the data. At best, the forensic would only get whatever the phone can still access.

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

There’s been some turnover over the last six months at my firm, and I have taken over more files. I’m having a hard time getting ahead of briefing schedules and have been asking for extensions on a lot of recent briefs. In my practice area it’s never really an issue or objected to. However, I feel guilty that this is still happening. Any tips for getting over this?

I work for a small firm (about 20 attorneys) and make 90k. I’m coming up for a raise discussion in a couple of months but don’t know how to go about it/what is reasonable to ask for. I bill about 35 hrs/week at 400/hr, so I think I deserve a bump, especially considering the posture of the market. Any advice/feedback from similarly situated associates or partners at similarly sized firms?

When drafting a brief or other submissions for court or arbitration, do you use words such as clearly, erroneously, etc. to emphasize certain points? Our managing partner says that we should, but all of the writing guides for litigators that I've read repeats the mantra "show, don't tell" and explain that most judges dread such words.

I know that the politically correct thing to do here is to do whatever the managing partner wants me to do, but I just wanted to ask for other ppl's opinion.

I’ve been working at a rather prestigious midsized firm in a big city for almost a year and a half now. I have been having a lot of trouble picking up work from senior partners. We are required to bill at least 150 hours per month to meet our requirement. My months are typically only 110-130 hours. It seems like the senior partners already have their “go to” associate for things. Does anyone have any suggestions on how i can increase my workload? I reach out for work pretty much weekly.
