It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

Former DA turned associate here, and my current bosses expressed this same attitude. Getting your litigation chops goes a long, long way in building your abilities as an attorney. The skills you develop in an intense trial practice translate perfectly to how your write and construct arguments, how you examine a witness in a dep, and how to interact with opposing counsel. I was brought on with another associate who had much more civil experience than I, but between us I’m the one who is now in charge of my own cases.

This is not only with attorneys — they also seek out senior paralegals with trial experience as well, not only for prep, but to show up to court to keep them organized.

It’s an ID firm. This is fairly common in that realm.

Unless you do criminal work as well, it’s going to be a self-defeating prophecy. They won’t let you try cases bc you don’t have civil trial experience but you don’t have civil trial experience bc they don’t let you try cases. So at least at my firm they just now hire former prosecutors or DA’s. Which is sad bc we have some excellent civil litigators who just don’t have a criminal background.

FL peoples: I signed a lease for a new place to start May 1 as my current landlord sold the unit I'm in. Turns out, the buyer wants to keep renting the unit and asked if I want to stay. Trying to get ahead of my caseload feels like trying to climb a hill made of loosely-packed pebbles. No matter how much I scrabble, I’m sliding closer and closer to the bottom.

How do you get caught up (or even ahead) when you’re always behind? Assume that all things that can be offloaded have been offloaded. I cannot take one more all nighter trying to get a motion drafted two days before the deadline because I couldn’t get to it earlier.

Does anyone work at a firm where legal assistants don't do legal assistant things? For example, I have to do my scheduling and calendaring. I have to upload documents to our file management system. This morning, a name partners assistant didn't realize the name partner had a depo and didn't confirm it. This is how this firm as been for decades and it's incredibly frustrating to work this way. It's so hard to not stress over this daily.

Is there such place as non toxic ID firm? Or does any of ID attys like what they do? I moved from general practice to an ID firm six months ago. Biggest mistake of my life. So is it just me or do people who have been doing ID for decades generally fall into one of two groups? The first group are cynical people who have been divorced, their kids hate them, etc. then the second group are BS artists who are skilled at avoiding both work and responsibility for anything?

I often hear lawyers threatening to “call the judge” during a deposition, generally when there is a dispute among counsel over a question that has been asked. Has anyone ever actually done this? What exactly is the judge supposed to do, resolve the dispute over the phone?

I’ve been working at a rather prestigious midsized firm in a big city for almost a year and a half now. I have been having a lot of trouble picking up work from senior partners. We are required to bill at least 150 hours per month to meet our requirement. My months are typically only 110-130 hours. It seems like the senior partners already have their “go to” associate for things. Does anyone have any suggestions on how i can increase my workload? I reach out for work pretty much weekly.
