Aren't non competes no longer enforceable? Think it's been one thing the Biden administration actually did recently to help its own citizens.
It has been legally challenged. The decision has not been made yet, but fingers crossed 🤞
Hard one to answer. Definitely a legal question but you certainly have grounds to stand upon. Especially depending on the state. One thing is for sure though, they will likely fight you on it regardless.
It makes sense that it can vary from state to state.
I’ll tell you that I work in one of the most liberal states in the US and yes, even if you changed title/job description, the non compete is still valid.
Non-competes are weak. If thst job is all you know, a company cannot prevent you from working for competition. But what you should not do, is take the companies customers, product ideas, or procedures to the competition
Non compete clauses are illegal no one can prevent you from your livelihood don’t worry about it!
They can’t enforce a non compete. You’re good.
It depends where you live/work, but they usually end in a settlement with a negotiation.
