I'm thinking of leaving, is the grass likely to be greener?

I'm a 7 year attorney, at this firm for 3.5 years, and it's just me and one other attorney (the boss). When I first started, I was brought on to do litigation. My boss works on the cases medically. This tactic has been working. However, recently my boss has just been blowing through firm funds through unnecessary exorbitant costs. It's to a point where he wants to apply for case funding for almost every case (bad for client) and...

Even has started having clients pay for half of the costs (unheard of in PI). All of that makes me really uncomfortable and I don't find it ethical. He also has been having more of a say in litigation and has me filing motions that are frivolous and degrading, calling OC a liar, etc. One reason I left ID was because I was forced to file frivolous motions just for billing. The boss is also bipolar (undiagnosed but seems like it). He'll go weeks of AWOL and then weeks of nonstop working and he'll have opposite temperaments often. Lastly, the office has no structure and it's not uncommon to miss a filing or deadline because the boss missed an email months ago. My only worry is that right now my work life balance is amazing (unless trial, rarely working over 40 hours/week). And with two kids (oldest 2.5), that's very important. I'm hoping to find somewhere with a similar work/life balance but with colleagues, more structure, and less unethical practices. Am I being too picky? Thanks all!

It seems your boss is committing malpractice. I would look for another opportunity. There is work life balance other places as well.

Generally, I’d say the grass is not greener. But this seems like the lawn may be dead in a year or so. This operation is not sustainable.

Get out!

What does “works on the cases medically” mean? Could you start your own firm?
Also, it’s hard to tell whether the grass will be greener without knowing your comp and market.

Any idea about greenway health?

We are seeing more pushback from employees on working 40 hours. We offer flexibility (wfh), 11 holidays and another 3 wks PTO. Seems like a good gig, I think, at 40-45 hrs. Anyone seeing this too?

How much support staff is reasonable to expect? Plaintiff PI, med mal/aviation and we’ve lost 2/4 “paralegals” in the last month. Lack of support staff really beginning to feel like it will limit my ability to handle the usual caseload. Was on an island before, and only going to get worse…

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. Contemplating taking a couple interviews at plaintiff's firms to see if there is a good fit. Does anyone have any advice on how approach discussions about compensation and what a market level comp package would or should look like?

In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I am currently handling 150+ mostly MVAs and premise liability cases, just about all in suit, (on top of about 10 DUIs and other small traffic matters) and I feel like I'm drowning and looking to jump ship. What is normal/to be expected? In NYC area if that matters
