Is it common for PI plaintiff attorneys to receive a percentage of the fees for cases they work on and resolve but don’t originate? If so, what’s a reasonable percentage?

Yeah, we have a base salary of $80k but it works as a draw and then we get 30% of the attorney’s fees for cases that settle at $50k or lower, 20% for cases that settle between $50.01k and $99.99k, 15% for cases that settle from $100k to $249.99k and 12% on cases that settle at $250k+. Ends up working our pretty well, even with the draw

@Partner 1 that's probably more than anyone short of the owner of my firm makes, but Texas is also a much better state to practice PI than Ohio.

Yes I get a base plus 3% of what I settle, but I’ve been at firms where its lower base and higher percentage, and then also where commission starts after it hits a certain amount of fees

Base plus 5% of what I settle with up to 10%. I get bumps to my percentage for every $250k within a year (so 10% on anything over 1 million, 7% on anything over 250k)

Any other loan officers in here? I'm trying to decide if I should dig in with the current market or look to pivot. I've only been a loan officer since 10/2020. So this is my first rough patch. For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I am currently handling 150+ mostly MVAs and premise liability cases, just about all in suit, (on top of about 10 DUIs and other small traffic matters) and I feel like I'm drowning and looking to jump ship. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. 4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I respect the solo a lot, he’s a mentor, but I’ve got kids and I gotta get paid. Trying not to burn bridges, but I can’t wait years to get cut in. Advice?

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??
