Childcare Hours and the £100k Income Threshold: Here's What You Need to Know
If you earn over £100,000, your eligibility for 15 hours of free childcare in England depends on the specific scheme and your child's age.
Universal Entitlement for 3 and 4-Year-Olds: All families in England, regardless of parental income, are entitled to 15 hours of free childcare per week for 38 weeks of the year (term time) for their 3 and 4-year-old children. This entitlement typically starts from the term after your child's third birthday. Earning over £100,000 does not disqualify you from this universal 15-hour offer.
Working Parents' Entitlement (Extended Hours and Younger Children): This is where the £100,000 income threshold becomes crucial. The government offers additional childcare support for working parents, which includes:
* 15 hours for eligible working parents of 2-year-olds.
* 15 hours for eligible working parents of children aged 9 months to 2 years (this is part of a phased rollout, with plans to expand further).
* An additional 15 hours for working parents of 3 and 4-year-olds, often referred to as "30 hours free childcare" when combined with the universal 15 hours.
For these working parent entitlements, there is an adjusted net income limit of £100,000 per year for each parent. If you or your partner (if applicable) have an adjusted net income exceeding £100,000, you will generally not be eligible for these additional funded hours.
Understanding Adjusted Net Income: It's important to note that the £100,000 limit refers to your 'adjusted net income'. This is your total taxable income less certain allowable deductions, such as:
* Gross pension contributions
* Certain charitable donations made under Gift Aid
Therefore, even if your gross salary is above £100,000, you might still be eligible if your adjusted net income falls below this threshold after these deductions.
In Summary:
* If your child is 3 or 4 years old: You qualify for the universal 15 hours of free childcare, irrespective of earning over £100,000.
* For the additional 15 hours for 3 and 4-year-olds (making it 30 hours in total) or for the 15 hours for eligible children under 3: You (and your partner, if applicable) will generally not be eligible if your individual adjusted net income is over £100,000.
I know a lot of immigrants (Non ILR) end up taking both these benefits and somehow it doesn't get flagged anywhere. It's a matter of time though, as told to me by my attorney. Hmrc is tightening the screws everyday and Accenture has been hired for this!
There’s plenty of reels on Instagram of all places about this £100k tax trap. I got stung last year as a bonus tipped me over the threshold and then to add insult to injury, HMRC hit me with a £100 fine for not completing a Self-Assessed Tax Return (for high earners over £100k). I think this threshold has now been increased to £150k for this tax year. Your best bet is to throw the excess into your pension, take unpaid leave or avail of one of the bike or EV car schemes which will push you back down under £100k.

I suspect whatever you pay in your pension will mean that your net pay will be below £100k, so you might be fine, but I found this for you https://www.reddit.com/r/UKPersonalFinance/s/TSr5IgBgUM
That thread is super helpful, thank you - it works moving forwards. Phew! I need the cash - £100k doesn’t buy anything like what it used to!

I had this situation a few years back. As soon as I realised I was going over, I stopped using the TF CC and free hours. I've never been asked to pay back.
