On average what would you say is reasonable to bill to summarize a Plaintiffs deposition. Both on liability and damages. These take me forever to do for some reason.

It depends on how long the transcript is but I usually bill about 1.4 - 1.6 to draft the report.

5.1 if it is a long one. Mine can turn into a 15 page report.

There’s not really an average, so bill as long as is takes you. As you do more of them, you’ll pick up speed.

If you haven’t gotten any pushback from partners on the billing, then I wouldn’t worry about it. Some things just take a long time.

Hello All,
I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?

New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. Contemplating taking a couple interviews at plaintiff's firms to see if there is a good fit. Does anyone have any advice on how approach discussions about compensation and what a market level comp package would or should look like?
