I understand your concern for your property — but it’s overrun by my horror towards how nonchalantly you mention a woman getting hit with zero regard for her safety. You have insurance as a landlord. Please care more for your tenants! Geez
Could look into the tenant getting a temporary restraining order for the immediate term. In a similar experience one was granted nearly immediately and was in place for a couple weeks until a hearing at the courthouse
The tenant has to file the TRO. I am wondering whether or not we can evict them based on the situation. They signed a 6 month lease. November until May.
I am not the direct landlord. My elderly in-laws are the landlord. I am seeking guidance to help protect them. The male tenant is gone for now. And don’t know what else i can do.
I believe there are certain measures that are legal in cases of DV (you might be able to change the locks because she is a victim but not sure if it’s before or after the restraining order) but you should consult a lawyer
Focus less on the ADU and more on protecting the victim of DV, grossly dismissive and selfish angle to take as a landlord, I'm sure she'll have more time and comfort to work and pay her stay with him gone and not on the lease after leaving, but trying to evict her doesn't show any care or desire to protect anyone/anything but your property, which you should have insurance for.
