Was approved for an apartment that was originally listed as no-fee, but just heard from the broker the building isn’t paying the broker’s fee so we would have to pay it. It is one month’s rent but they are saying we can pay just 1/3 of it due to the miscommunication. Thoughts? Is this a scam? Is there room to negotiate?

Just stick to the original approval document saying no fee. It’s the broker’s problem, not yours. There is nothing the broker can force you to do.

Screen capture of the listing saying no fees advertise etc? I’d politely dispute. If he pushes you to pay by asking a forgiveness for miscommunication or scam, he did a false advertisement, legally. It’s not comfortable to dispute, but talk straight and see what the broker says. The broker can’t take away your rent approval at this point. If he/she is smart enough, won’t push further. At worst case, you can leave the broker alone(no money, no time of the broker) at this point if the broker just ditches you unethically, then draw a lease agreement with the building management office directly but it depends on a building. Either case, it’s not fair to you.

How can I check if it is a scam?

This isn’t something you “check”. You were told one thing and now it’s something different. I’d consider this a clear example of false advertising or similar to bait and switch.
If this is an apartment you really want, I’d push back with the broker. Good luck!

That’s why I don’t deal with brokers, always rent directly from the building.

No annoying intermediaries, no additional fees

Call the building and ask them whether they pay the brokers fee to find out if the broker is lying
