Prepare and try the case. If you’re worried about a verdict more than the current offer and more than the potential settlement could be, then document it in your reporting (you have probably done this already). Defend the case as best you can at trial — if you reported that the case could’ve settled at $X, if the verdict comes back bad, you’ll at least have protected yourself a bit. Good luck.
Get ready to try the case and bill your ass off lol. Then they’ll pay the day before or morning of.
Keep pushing for more money, remind them of your defense costs and be ready to try it. Sometimes they want to push their luck at trial and there's not much you can do to avoid that, so just be as prepared as you possibly can (and don't be surprised if you settle the night before).
I agree with those above! Out of curiosity, what venue is this in? Just wondering if it’s more plaintiff or defense friendly. I’m in NYC and pretty much any of my claims people wouldn’t be able to throw $20k at me fast enough to stave off a trial😂
Would love to try a $25k limit case. You learn from the exp and minimal stress risk
You go all the way. You have to be ruthless.
The insurance has a duty for their insured. Or they can sue them for malpractice 😂
Try the case.
I was literally going to suggest the same thing as attorney 1. When we have something happen like that we pretty much ride it out and act like we are going to trial. Nine times out of ten they want to settle the morning of. It never fails.
