I try to ask early in my shift about my break. My managers are pretty good about scheduling them early so we don't have to wonder when or if they're even going to happen. Maybe ask your manager if you could start doing that?
I work for Jewel Osco and we always get our breaks, might be early, might be late, might have to check and see if they marked you down as having break and never told you. Our store has a different opinion on lunch you have to ask for lunch on any shift over 6 hrs. Once you do that your longest shift that you'll get is 5 hrs and 15 minutes, isn't being in a union great.
I've always found that it gets down to each manager. Some of them really don't care, they're fine with you taking a break as long as you let them know. Others get offended like it's their own time you're stealing. Some of them just like giving people a hard time, I'm convinced of that.
Always refer to your HR manual for questions and answers it is your best resource not by hear say.
I stand my ground, I don’t let myself get pushed around not even at work…I’m easy going until I’m not. Usually, in a case like that, I tactfully say, “I understand we’re busy, but I need a break and I’m going to go” as long as its close to my time, my time to go, or my time to go had already passed.
I support my coworkers who are on top of their breaks and take care of themselves while at work. You can not offer anything to customers if you're dehydrated, low blood sugar, have pain , and/or are exhausted. As long as we tell the manager that we are scheduled for break and need coverage, I have never heard of any manager saying No or it's too busy. I am grateful for their recognition of how important breaks are!
I stand my ground. There’s no reason why someone working 8+ hours shouldn’t get a break. We’re not robots. I’ll even go as far as a 30 min lunch isn’t enough time to do what you need. It should be a hour. Also the managers probably act like that if they get bonuses.
OMG! I totally agree that 30 minutes for meal breaks is not enough. I would rather have my 30 minute meal break and my paid 15 minute break together. By the time you wash your hands, use the restroom, get settled and maybe heat a frozen meal in the microwave... you have about 7 minutes to eat. It's like being in school as a kid! It's unhealthy to eat like that
I’ve always let my people have breaks at reasonable times. Even a couple extra smoke breaks as long as there’s nothing more pressing at the moment. Just don’t abuse it. I do however expect staff to be getting their assignments done though. I try to be fair.
Hate inconsistency between managers. Smoke breaks should not be extra time on top of your 15 minute break and your meal break. Non smokers don't get extra breaks. In fact I am going to raise the issue with the team this week. I can barely get a 5 min break to pee! Sometimes I can't use the bathroom except when on break because I have nobody to cover me. Smokers are not entitled to extra break time. Addiction is not an accommodation. You can't have extra break time to have a vodka tonic or smoke pot. And the vaping is out of control. It's against the law and has been since 2019 to use e-cigarettes or vape in any business in NH. The same as cigarette smoking bans. Nothing like vaping in my face when I am assisting you. I immediately tell them it's against the law and that they should leave it in the car because we monitor incidents of vaping via camera and it can get you banned from the store. It's disgusting and I resent anyone who has no regard whatsoever for others who might have respiratory problems. Or they light up with a customer who has oxygen flowing into their nose! Idiots.
I don’t know much about retail but not giving your employee a break after working 6 hours is highly illegal here in California. Look up your labor laws in your state and then school your manager if they aren’t aware. Restaurants get sued here in Napa all the time for not giving breaks to their employees who are usually on their feet for 8-10 hour shifts. Stand up for yourself and don’t let them push you around!
Go to State Labor Board or OSHA. They never reveal the source of the complaint but they show up that day! So don't mention OSHA before you file the complaint. I love OSHA. They are on the side of the law. They have no expectation to protect the employer

I personally don't have choice because I'm diabetic. I was on the Gig and had to ask for My Break because the girl that came in After me got her break before me. Then when I mentioned it to the Mngr it was like I was confronting her🙎🏽. And then she told me that the other one Worker was there first, I was like she wasn't because she asked me for you.😐 I'm very upfront, outgoing, outspoken person but I do know when to be cool. However, I'm not a kid so I'm not going to sit back and let you take advantage of my time. 💯 I understand I'm being paid but I'm not being paid to be a slave. 😑 I'm a Merch Vendor and used to working On My Own unless we have a Team Project. 🤷🏽♀️

Stand your ground for sure. You can always ask at the beginning of your shift what time the supervisor will have you take your break. That way you have something to hold them to. It is up to the manager to make sure they have enough coverage for ppl to take breaks. And if they don’t, they have to roll up their sleeves

Yeah I'm guessing it's better to set expectations early in the shift get everyone on the same page.
I feel so bad for you on this, breaks give you the chance to recharge, you shouldn't have to ask for a break it is something that should be outlined in the company policies, for years I never took my breaks, but I always made sure my team got theirs. Happy team members = Happy customers or guests= Happy Boss depending on what type of work you do but you should never let anyone ignore you or say your too busy. Put your foot down, search up what your company policy is then see how you can help enforce it.
I would go by the Human Resource By-Laws and Terms and Conditions is your bible for justification and confirmation, also to protect your rights.
We are supported by management 100% to take our breaks. OSHA violations are anonymous!!! If they don't have employees initials verifying they took a break it's illegal.
But remember that HR works for the organization. They are not going to do anything for employees that will cause the company any problems. Always seek outside regulatory guidance from your state and OSHA.
