I can say as someone who used to deal with ADA requests, it's not always a guarantee that it will be allowed. It's not the same rules as a service dog in public. They can ask for documentation on both the disability that requires a service dog, and documentation on the dogs training. For where I was at, it was a non profit who actually helped people with disabilities so we didn't go to deep into the process and for the 2 people on the 12+ years I worked there, it was an easy allow. A large well known company might be another situation
As long as you have the documentation, you can say how your work may be an issue without the service animal, and it doesn't create a hardship for a company, it shouldn't be a problem.
I don't believe allergies is an acceptable reason, it's a simple fix of moving either the person or the person with the service animal. You also can't deny based on something that may or may not happen. It has to be something big that would actually impact a company financially or interrupt functions of the work. I really doubt many companies fight a service animal, but I'd imagine it's happened. The specificity in the laws would be a hint that it's been a road traveled before.
Manager 1- legally yes it's against the law. Unfortunately not many attorneys handle this type of law, especially where I live. That's why I want to start preparing myself early. If I was able to be fully remote then it wouldn't be an issue but we are hybrid. And I have a feeling eventually they will try to move everyone to RTO and if that happens I'll need a SD to help me with my medical issues.
Thankfully I have a great dog trainer in my area and a few new friends who live here that have SDs but none of them work in a corporate environment.
ADA accommodations are not a forced acceptance, legally speaking. There are cases where an employer can deny the requests. It probably doesn't happen often because no one wants to deal with that, but it can. So no it's not necessarily illegal to deny. If a company can prove it would be a hardship on them, they can fight it.
