Lump sum payment is good. The next day, you can file for unemployment. Marketplace insurance is horrible. Just use the COBRA coverage. You can pay into it for up to 18 months. Month by month. Then start looking. I found a new job in under 2 months. Good luck!!
Attorney fees would be worth it if we’re talking about a lot of money, but if the severance package is good, then not worth it. One question to ask is, when can I apply with the company that laid me off. My severance package stated 2 years.
Are you in any protected classes (including disability) and might you have a discrimination or retaliation case? If you have any suspicion this may be at play in your case, I would discuss with a plaintiff side employment attorney.
As a general matter, I would have an employment attorney look at your severance agreement. It may cost a few hundred dollars but uncover a claim or provision/protection that is worth more to you—so it will be a net gain.
I was laid off recently too. I negotiated two months of cobra paid by the company, and two extra weeks of severance (they had given one week per year). I’m not sure how an attorney could have negotiated more but maybe I’m wrong. Get any outstanding expenses/WFH/fitness reimbursement gets paid. Sorry to hear you got laid off, you’re not alone!
These replies are helpful. I just got laid off last week and I had a guaranteed bonus coming in December. I was wondering if I was entitled to a prorated amount for the months that I’ve been there this year. Does anyone have a comment on that? I have a signed document from the owners of the company when I startedthis position that says I would get a guaranteed amount every December and it wasn’t based on anything like performance, etc.
