There needs to be more than 33% of a company let go all at once.
AD1-that would only be when a plant closes.
Here’s what constitutes a violation:
- A plant closing that results in an employment loss for 50 or more employees in a 30-day period.
- A mass layoff in which at least 50 employees are laid off and constitute at least 33% of the workforce, or if 500 or more employees are laid off, regardless of the percentage. (IPG and Omnicom has over 130,000 employees combined and the layoffs are most likely spread out so no one single company in the network is losing 500 people.)
- An employment loss from a temporary layoff that becomes permanent or is extended beyond six months
Not a 100% sure how antitrust laws work in the U.S. but can they apply to a merger like this?

There are staggered end dates. It’s legal because they are giving a percentage the 30 day warning.

For NYS WARN it’s 33% OR 250 employees laid off at a site in NY within 30 days. NYS DOL (WARN@labor.ny.gov) should be contacted to file a WARN complaint to investigate Omnicom as layoffs were massive. It should be 90 days pay and 3 months benefits. Omnicom has cut corners on PTO payouts, severance policy cap, holidays, and other benefits and policies. I’m sure they cut corners here!
