I am licensed in ny, and someone from fl wants to utilize my license to handle a case in ny. They just want me to file it, they'll do the work. I know i still bear liability, however, I have 0 clue what to charge for services like this....any guidance?

This is common. You are being retained to guide them through local rules and procedures while they do the substantive work. You are a local counsel. Take the easy $$!

We work with many lawyers out of state to do just that. They take a look at the complaint to make sure it complies with local rules, help us prepare and file the pro hac, and generally take a look at anything that gets filed. We generally pay $5,000 flat fee. If they end up doing more substantive work we’ll discuss a percentage of the fee but that rarely happens.

We charge 7.5% of the fee on class actions to act as local counsel. Is this just a singular case? They can't pro hac in?

They can but in ny they still need a ny licensed atty on the record

What’s the learning curve making the move from ID to PI? 6th year at an ID firm and just got an offer from a good PI firm, but just nervous bc I’ve never been on the plaintiffs end before.

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

Anyone know a Connecticut or 2nd circuit case for this rule? I can’t find one to save my life. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

Hi everyone - I'm contemplating an offer from a large PI firm. I'm a little more than halfway through completing my 2nd year of practice, and I'm currently at a small firm with a low salary that's just no longer cutting it.

The offer from the large firm is for a pre-suit position, base salary of $100K - is this salary pretty standard for this kind of position?

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

For Plaintiff's attorneys, how big is your caseload? What kind of cases are the majority of them and are they in suit? I am currently handling 150+ mostly MVAs and premise liability cases, just about all in suit, (on top of about 10 DUIs and other small traffic matters) and I feel like I'm drowning and looking to jump ship. What is normal/to be expected? In NYC area if that matters
