Ohh I hope you consult with a lawyer. Something isn’t right
Well first, I’m really sorry that this happened to you. Losing a job, especially when health is involved, is tough. I don’t think anyone reading your post would minimize that.
That said, reading your post as an outsider, it sounds like your supervisor actually tried to point you toward a solution by recommending FMLA. It gives employees in exactly these situations options to work with. Once you were approved, though, the responsibility shifted, now you had to use that process correctly.
It sounds like the same call-out method was used several more times after approval, even though there was now a different (and safer) way to handle it. From a supervisor’s perspective, that likely looked like the issue wasn’t being addressed, even if that wasn’t your intention.
Also, and I say this with care, if you didn’t know how to use the FMLA system, that was the moment to ask. Supervisors can guide, but they can’t read your mind to know what you don’t understand unless you tell them.
None of this means you’re a bad employee. It means this was a breakdown in follow-through and communication, and those are fixable. This isn’t the only job out there. Take what you’ve learned here, you’ll be in a much stronger position for the next one.
Thank you so much for your feedback. I completely understand what you’re saying, and I can definitely see it from their point of view as well… But as someone else stated, I just feel that it should’ve been common sense to use my FMLA because all of my callouts were always diabetic related. and if we call out, we simply send a text message to phone… She will never respond in my last five years. never gotten a text my message. She has done this with every employee which I feel is a bit ridiculous given some of these people are not used to back. So I’m not sure that I would’ve even have known that she would have applied my FMLA because she wouldn’t have responded to let me know that she would do it. My last write up was back in July 2025, so I honestly thought that my FMLA had been being used. But like I said at the end of the day, it’s my fault for not going back on the website to check things, making sure documentation was done, and following up with my supervisor to confirm that my FMLA had been used. It just sucks that they have literally just ruined my life for the moment. struggling very hard right now and not having a job ready to go to can be difficult. I just hope that they understand that they could’ve done better as a supervisor if they had just tried reaching out, knowing that that person had a health condition and been more on top of their employees with their callouts and given them fair warning that they were about to lose their job If one more call out taken place… all of this would have triggered the employee to ask “wait what about my fmla???”
After over 10 years as an Art Director in major NYC Ad Agencies, I went to MSKCC and was schooled for 2 years as a Radiation Therapist. It has been incredibly rewarding and interesting. I've learned a lot of new technologies and enjoy the patient/Therapist interactions.

This sounds sketchy! Make sure to document everything!
I was finally approved in sept 25. they received my approval through an email and I asked if there is anything else I would need to do for this and was told no. Following this I had 4 more call outs between October 2025 and April 2026. I was terminated april 2 after I called out bc of my diabetes acting up the night before and had been throwing up and dehydrated. Before our job even started (I sit in the parking lot for almost 40 minutes every day because I rather arrive early than deal with traffic) the next day I was told to come into the office and I was given my dismissal. I had no chance to say use my fmla, but besides that I have apparently Had never used any of my fmla time. I asked why they never asked me why I wasn’t and they said that’s not their Problem. I have never

een in trouble or been written up for issues other than call outs. If this supervisor had just asked then we could have figured out that I had NO idea how to use my fmla through the website or that I had to notify my supervisor each time I called out.. I feel so stupid that I didn’t read all of information about fmla but at the end of the day if the supervisor had cared just a little bit this might not have Happened
