Id argue youre conflating the network Fox with Fox News on cable. There is a massive legal and regulatory gap between broadcast stations in thr united states - ie ABC, CBS, NBC, and the Fox broadcast network which are on public airwaves and cable stations (Fox News, MSNow, CNN) which are not and thus not beholden to these regulations.
Its still BS - as up until this year the FCC considered daytime & late night talk shows on broadcast networks (The View, Kelly Ripa, Colbert, Kimmel, etc.) as exempt from these regulations. And they should be considered that still.
They considered those shows exempt because they "served a bonafide news interest".
Nobody watching the View could possibly think that applies. Colbert, Kimmel, etc - that's more open to interpretation as they've definitely given legitimate interviews before.
Fox doesn’t have to because their channel isn’t news, which they’ve stated in court.
This wasn't a Democrat vs. Republican issue. It was about not having to give equal time to two Democrats vying to be their party's candidate in the Texas Senate race. If they gave Talarico airtime, then they were afraid they'd have to give his opponent, Jasmine "Ratchet" Crockett equal time.
