You can try, but you will lose. Quickly.
"It's not in the handbook" is the lamest excuse for doing something that is clearly unethical. Does ANY handbook have a prohibition on peeing in the hallway? No? So that means you can't be disciplined for peeing in the hallway?
What you did was unethical, period. You took advantage of an employee perk and tried to profit from it. Now, I know that a bunch of people are going to scream "HR sucks!!" and "all companies do is screw over employees, so employees should do unethical things!", but the fact remains that you unethically took advantage of something the company provided to you and profited from it, or attempted to.
You have literally zero legal case here.
Ethics? Most companies have very specific policies regarding employee discounts, and they usually prohibit resale. If you violate the policy, it can lead to termination. If the employment handbook explicitly states that reselling discounted items is not allowed, you can be terminated.
Respectfully, I think what is more worrying is your lack of self awareness. The whole point of a company discount is an incentive reward exclusively for their employees therefore your decision to resale on social media to make profit signals a lack of integrity and judgement. Rather than finding a lawyer to sue why don’t you use this time for reflection to see how you can do better. On a different point, if you need a reference from this company for another role, there is a chance it may not help you. You can try suing but I think a a lawyer would see this case as a way of making a quick buck knowing you have no case. It would good use of your energy to reflect of why you made such a poor decision that has now cost you your job and how you can do better in future. The key is learn the lesson and don’t repeat this type of poor judgement.
No, it’s not like taking vacation, it’s like taking the stationary from your office and sell them online for $$$
No, your employer didn’t raise your rent, they are not responsible to pay you more because your landlord has raised your rent. If they didn’t fairly compensate their employees then the employees can go find another job, if the employees don’t then that’s “poor judgement” on the part of the employees, not the employers.
See what your work policy is.
If I buy an item on sale and decide I don’t need it am I allowed to resell it at market price even though I bought it for less? Once Ive bought the item it is my property and I can do with it what I want, right? When we buy something, we basically agree to exchange ownership of it for a cost. Once the ownership is in my hands, how could anyone have a say over what I do with it?
they have a say because they co-paid, so it’s co-ownership
If the items are used more than 1 to 2 years, you post on Social Media for sale, I think the company has nothing much to say. But if the item is less than a year or even just a few months, I suppose you are just trying to abuse the benefit’s and to make something out of it.
Does it mean if you have worked in the company for more years means you will have the right to abuse the company policy!!
I sorry for you, but I feel the HR is doing the right thing. Whether new or working long in the company, company HR should treat all staff equally. Otherwise the company will be in a mess.
This is also a good warning to all employees in the company.
That wasnt wrongful termination. I've worked for companies with the same policy. There are handbooks for a reason. So employees know the rules ahead of time. You're expected to follow them all, not just the ones you want to follow. If youre terminated for violating a company policy that's not wrongful termination.
I think the company could have handled it differently. Maybe Issue you a final warning or something to that effect especially with no previous issues.
Is there anything in the policy that states this a violation ?
I don’t think you’ll win if you attempt to sue… on what grounds are you suing? It has to be a legal reason why you are suing for wrongful termination. Discrimination, age, race, sex, religion….
You’re the reason why many companies have withdrawn employee discounts, etc
Sounds about right. You're scalping company profits. The privilege of the employee discount is yours not everyone's. I worked at a company that gave discounts for employees as well. You should know better. The fact you posted this is very bold of you. Sort of worried you might have ruined your job prospects. I think you should delete this post immediately if possible.
This brings back memories… nearly 30 years ago, a co-worker was using our company discount to buy really nice office chairs from a third party and he was reselling them. He had sold enough of the chairs that the chair company noticed and reached out to him and said “we don’t know how you’re selling our chairs at such a deep discount, but you should stop now unless you want us to investigate and find out”. He stopped immediately 🤣
I think it depends on the state you live in. In my state an employer can fire you for just about any reason except for things like a protected status.
What was the item? And is it still for sale? asking for a friend
When i was 15 i worked retail and we had a promotion with collectible phone cards lol. I put some on eBay and was fired within the week. Lesson learned lol.
Your lack of awareness is concerning.
You were dumb. You still are dumb.
