Lawsuit against who? The police department?
civil lawsuits are not even tracked. But if you are guilty and still filing a lawsuit then I am not sure what happens. Who are you filing the lawsuit against ?
No - it is against the person responsible/their insurance. For pain and suffering damages.
No repercussions. But please tell us entire story first.
So I got rear-ended by a person pretty severely, this pushed my car into a third - my airbags deployed so my injuries are minor.
A police report has been filed and my car is now a total loss. The insurance is providing me with a settlement of the car’s value before the crash. This valuation is fair but it’s obviously a loss for me overall
OP, are you swayed by the lawyer ads you see on TV? If you’re suing only based on that, trust me, you’re not going to get a lot cos of the fees.
Now, if you are unhappy with the settlement amount for the car, you should spend time emailing them your concerns. For e.g., did you buy your car new? Is the used car market higher such that you can’t find a comparable vehicle etc. etc.?
But most importantly, I’m glad you are ok.

OP, you need to understand that most of these “cases” do not ever see the light of day in a court of law; they are settled way before that.
Hire a good personal injury lawyer. Most of them work for free, and charge 33% of the amount recovered (which can be in the tens of thousands). They will send you to their own doctors, and will pay for those doctors too. Then they will write to the other guy’s insurance company, and ask for damages. Your case sounds typical, so it will almost certainly be settled before court.

Thank you P1, yes - you are correct. After a lot of thought, I am not hiring a lawyer. I think it’s a loss for me to basically give away 33%. I am still getting my medical expenses covered by the other party. Nothing major so I’m fine.
Also, the amount of calls I ve been receiving is getting out of hand. It is really not worth the time to actually do this unless you are injured pretty bad 😐
