I was just let go from a small investment management company after year and half. My boss told me I was not getting up to speed soon enough. I have a feeling this was really about a disagreement we had regarding a matter. They offer me a lump sum or to stay on their payroll for 3 months which amounts to half of the lump sum. They also offered references. Would you take a lump sum or remain on their payroll in hopes this will help find another opportunity? Any thoughts are much appreciated.

As someone who went through two transitions (one involuntarily and one voluntarily) during a 35 year career, take the money. Any advantage of looking while employed is psychological at best. Money is the most important thing during a job search.

Are you able to take unemployment benefits if you take either option? Also ask if they are willing to extend medical benefits - assumes you need these. If you don’t need, then why stay at a company that doesn’t want you? Although it is better being employed when applying for jobs and most companies put up job posting beginning of January after people take their bonuses.

Sorry to hear you’re dealing with this. What are the advantages of staying on the payroll? My initial thought is 6 months of pay >>>3 months of pay, even if the 3 months includes benefits payments, but I must be missing something. Are they offering references in either case?

I think it might be harder to find something in 3 months while appearing employed than in 6 months simply chalking it up to a RIF/company economic conditions. But depends on a ton of individual factors.

6 months is better than 3 months. Can you string together unused PTO, sick days, severence, etc. to have the employer continue your company insurance before COBRA kicks in? That's become a huge cost in recent years.

I’m in-house at a small company (60 people), started right out of law school about 5 years ago. We had a legal team of 5 then. Everyone has left and we just hired a new GC. I went from $70k to $100k a little over a year ago. If you practice collections in-house, what do you earn and do you receive a bonus?

I have practiced for five years and make $121k as an employee of a financial services company. As the only attorney, I oversee all statewide collections efforts, from demand letter to garnishment, with a case volume of nearly 7k new cases per year, of which the majority I end up litigating. I receive only a $1k bonus per year. Is my compensation fair? My last insurance defense gig was $75k.

I have one pro bono case that I kept when I left my firm to go in house. It’s a matter completely unrelated to my company and I have malpractice insurance through the nonprofit organization associated with the case. I’ve made clear to my client that I’m repping this client in my personal capacity.
