If an associate is the primary contact for a partner’s client, and that client emails the associate and partner to introduce them to a prospective client, the associate and partner do the pitch together and get hired, should they split origination or does it all go to the partner? (Assuming the firm lets associates get origination credit.)

SHOULD they split origination? Yes. DOES it all go to the partner (anyway)? Yes. We operate in a world that is unfair most of the time.

like

It's going to be up to the partner. The partner probably will not share it, because they get money for originating, whereas the associate does not.

You can come up with other factors like who handles it and who really does the pitch, how senior and valued the associate is and how close to partnership, how generous the partner is... but I'd start with the above.

like

Depends on a lot, but the partner would probably take the view they were teaching you how to pitch business, which may be true, not that you were bringing in the work.

like

You should. The client introduced y’all as a team. And then y’all pitched as a team. So y’all should be paid like a team.

Anyone know when Ch. 7 BKs must close by? Is this changed by when there are adversary proceedings (alleged fraudulent transfers made to a bank for CC payments)? Asking for my friend who is unfortunately involved bc of his parents, who are the debtors (he isn’t a defendant or a debtor in this, but the payments were made to a CC in his name—a CC he didnt know was opened in his name).

Its in Texas, and the initial BK filing was made about 23 months ago. TIA!

I have a partner that calls me multiple times a day to talk about updates on our cases. Sometimes just to ask “anything to update me on?” He’s known across all of the associates for doing this. Most of the calls repeat information I’ve already provided in emails to him or the client. I normally bill this time as “strategize on” or “consider XYZ in further of” and it keeps getting appealed. Any advice?
