So I have been working as a barback/custodian for over a year, my boss only pays me $60 per day to clean his entire bar and $40 a day to do all the bar back stuff. These jobs are done in morning so the bar is clean and set up for the night. Did I mention he pays me under the table? I even asked about my possible cut of what the bartenders make and he denied me. I know something is not right. He also pays me on Cash app and Venmo, and its not reliable each week. What should I do?

It doesn't sound like a legitimate job to me. And I don't think you have the protections of a regular worker because you're not paying taxes and are not actually "employed." It sounds like your options are to deal with the conditions you have or to find a more legitimate employer and actually become a W-2 or 1099 employee.

like

What you should do is find a better job. If you're being paid under the table you're probably not paying taxes, so it's not like you can go and complain to the authorities. Get a job in a legit place and you'll be better off.

like

Incan go to the labor board but your job will be over and you might get some of the money back but then you might have back taxes I’m sure he’s not giving you a 1099

like

Do you work somewhere the federal minimum wage is enforced vs a state or city minimum? If so, $100 covers about 13 hours of work. That’s WILD, but it’s legal some places. So context matters. What’s not legal is paying and getting paid under the table. So if you don’t feel comfortable with the risk you’re taking, go find a W2 or 1099 job if you can.

like

Find a new job. In some case, employers would rather pay under the table with cash so they don't have to worry about taxes, benefits, and they can easily fire you. If it's something to do for quick cash, then so be it, but not ideal for a long term.

Can you reveal to me who it is so I can go work for him?

Hey barback, I been a mixologist for over 30 years and the answer to your question regarding should you receive anything from the bartenders and the answer is yes, because by you serving them with the stocking and keeping their bar replenished etc, you keep them looking good and able to perform good and efficient service to their customers. So yes each bartender supposed to tip you out .

Just kidding, if he didn’t give me more money, I’d report him

Is there any advantage to telling a company you are interested in working for in the future where you decided to accept an offer from? Or does it not matter? I accepted an offer a week ago with a great company (Company A) that for this season in my life seems like a great fit and only strengthens what I have to offer company B down the road. Company B just sent me a request for interview and I want to keep the door open with Company B but they were just very late in extending an interview.
