You either have it or you don't. The real skill is backing it up in conversation on the phone or in person. Many keyboard cowboys are weaklings in conversation. Personally, I strive for consistency across all modes of communication.

I’m a first year associate. I don’t feel like I’ve been tasked with enough work whereas other associates who’ve been at the firm slightly longer are swamped with work. Any advice?

Transactional associate. Lateraled 6 months ago and one of the biggest pain points has been my new firm’s inclination to “hop on a call”, which of course requires every single stakeholder to join. The end result being every call has 25 people on it and nothing actually gets done because no one wants to ask a question that could come off as silly. It’s destroying my ability to get anything done during the day. It’s a complete performance and it drives me nuts.

Negotiating a settlement. I’m at $10k, opposing counsel is at $20k. My client won’t go higher than $15k. OC has come down to 17.5k and says his client won’t budge from that. Do I offer 12.5k so we can hopefully meet in the middle at 15k? Is that how the settlement game is played? Seems dumb we can’t just say let’s meet in the middle now and be done with this. (I’m a first year, first time negotiating a settlement on my own and I don’t want to screw this up!)

How many billable hours per week is considered at capacity? I’m getting pushback on boundaries I’m setting about additional matters and marketing work from my firm when I’ve been billing 60-75 hours per week for the last 6 weeks, and I’m still behind on my work. I recently had a specialist partner send me a fairly nasty email after I (a transactional first year) was told to ask them to review something ASAP that had clearly been on my partner’s radar for over a week. Why am I taking the (honestly justified) blame for this? Surely it should be obvious that I’m just the messenger here.

Layoffs. Most big firms say they're sitting on a conservative pile of cash - which I believe is true - but work will obviously not return to pre-COVID levels in the short term, probably not even in the medium term. Are Biglaw layoffs coming?
