Completely depends on the current case value (current offer), stage of case (getting in pre or post lit), and how much counsel/firm will add value to the case, and often at what point does the case settle (mediation, pre-trial, verdict). Ive seen anywhere from 70/30 to 50/50, and even going the other way if stepping in for purposes of taking over costs and trying the case. You can also add a sliding scale based on the above, which is helpful.
In New York it is typically 1/3 of the fee for a personal injury case. However, I know of some other firms that have different arrangements, some of which involve a higher fee percentage
If you’re just filing the case and showing up when mandated by the Court but not doing any substantive work, I’ve seen it be 10%.
