I have been a Paralegal for a very busy sole practitioner. We had a couple of clients who fall into the category of making too much for free services but money is still tight. I would meet with them to sign pleadings, gather information, and whatever else I can handle to lessen the amount they are billed. I actually enjoy meeting with clients so I don't mind. I'm getting paid either way.
It's frustrating. People ask me for legal help all the time, but I can't do much without a lawyer's okay. It doesn't make sense that people struggle when paralegals could help with basic legal tasks. We could make a real difference if we were allowed to.
My state and a growing number of others have started allowing Paralegals to become licensed members of the state bar in limited capacity to serve the public directly. It began in 2017/18. I'm all for it. Most systems based on common law have two levels that serve the public anyway (Barristers/Solicitors) so I think the US is behind. Further, almost every profession has the same thing (CPA/Accountant; Dr./Nurse Pract., Mechanic vs Technician, etc.) Yet Paralegals are the only paraprofessional group specifically barred from direct service to the public.
Paralegals are already allowed to provide some assistance that is not considered practicing law such as filing out forms. This is just a natural progression and should be allowed. As this lawsuit is in my home state, I'm looking forward to it.
I wish I could help, but I’m constantly saying, “this is not legal advice”
The "missing middle" in the legal field is a significant issue. Many individuals can't afford legal representation but don't qualify for free services, leaving them without crucial support. Allowing paralegals to step in can bridge this gap by providing more affordable legal assistance, ensuring that more people receive the help they need. This approach not only improves access to justice but also leverages the skills and expertise of paralegals to make a meaningful difference. It's time we address this gap and work towards a more equitable legal system.
Wow the entitlement is real. 🤦♀️
This has nothing to do with entitlement. Paralegals can already provide assistance with filling out paperwork and some other things that are not considered practicing law. This lawsuit is just a way to expand on those services to provide assistance to an underserved market.
I don't know. I have mixed feelings on that. 1. Then we would have to get the same expensive insurance attorneys do for malpractice suits
