Ethics Q: my client created fruaduant medical documents in order to try to recover extra benefits from her injury. My thought is to settle her case with insurance company for whatever nominal amount is offered ASAP. However, this might be lower than her case is actually worth despite the the fruad. I would rather end representation as soon as possible. Thoughts? California ethics apply.

I would refuse to have my name on anything but that’s up to you. I would tell the client you are only continuing and doing the settlement for her if she signs an affidavit stating what she did and that you had no part of it. Just to keep in the file cause this is weird.

Other defense firms and adjusters will all know about it sooner rather than later and no one will ever and I mean ever take you at your word, stipulate to anything or ever work with you.

You need to seek to be relieved if the client won’t sub you out.

As a side note, you need to an an off the record conversation with Defense Counsel and make sure that they know you had no part in the forgery.

Withdraw. Don’t embarrass yourself with the carrier or defense counsel. Send a letter to client advising your reason for withdrawal so you have proof that you never intended on profiting from the case or the client’s fraud.

Get off the case ASAP. If your state is anything like mine, insurance carriers are REQUIRED to make a report of insurance fraud to the attorney general’s office. You do not want to be on the case if an AG reviews it. Trust me on that one.

You’re crazy to even think about trying to resolve this through settlement. Get out of the case. Yesterday. And then get out of your firm because being there has warped your ethical thought process. I’m sorry, what a nightmare.

Goodbye client... immediately. If you remain, you may be required to disclose the fraud to the court.

Your law license is your livelihood—withdraw.
