If you don’t receive your severance until at least 30 days from your last date of employment you can bypass the NY state law that you have to wait for your severance period to end before collecting unemployment. I was laid off with 4 months of severance but because I didn’t sign the agreement until after 30 days I was able to start collecting unemployment immediately. I was over 50 though and could wait the 30 days to sign.
As I understand it, they are two separate things. Your employer should explicitly tell you when your last day is, and when that last payment will be in your account. Separately, I’d you’re due a severance package, that is likely contingent on you signing the agreement... any such payment will likely not happen until they have the signed doc. They should have said this to you, but it’s such a blur for most people, so I reco you go back and look at what they gave you. Good luck with things, OP.
I’m over 40 and got severance only when I signed an agreement. It was mandatory in nyc for hr to hold the agreement for 7 days if I changed my mind. I got 4 weeks at once.
Just remember in NYstate (at least) any severance they give you, even if it’s all at once, is counted as weeks of income and against unemployment.
