Shouldn’t you be able to receive, negotiate and sign the offer in like, a week? Why would you need to quit that badly that you can’t wait like a good adult
Verbal contracts are legally binding depending on state law, so check your state law before you say verbal contracts are not legally binding. You're right that verbal offers aren't binding, but as far as I know, legally, if there is an offer and there is acceptance, there is a contract. In the state I live in, verbal contracts are binding.
And again, written offer is at will and I've heard of people's offers getting rescinded with no apparent reason, while someone I know had records on his background check that he had to explain every time he found new employment but he was still fine every time.
I took a 2 month break to recharge in between jobs because I don't have a family and I had savings. So if anyone asks about the gap, which no one has yet, I have some pretty cool stories I can tell them about what I did to grow personally outside that period. Having a gap between employment doesn't have to be a bad thing.
Seriously, conventional wisdom on this is not always right. Is there a risk of the offer not coming through? Yes. But there is also the risk of the offer getting rescinded after the written offer comes through anyway. I was basically desperate at the end to get out because I hated my last job so much and dreaded going into work, and to this day I have no regrets about quitting when I did.
Had a verbal offer and was rejected by HR 36 hours later. Big K is the epitome of class.
A good friend of mine got a verbal offer from a boutique bank and quit then the team/group he was supposed to join was completely dissolved a week later by surprise, managing directors and all. Kind of a fluke I guess. But I would definitely wait until a written offer is in hand.
BDO1 and SM1 What happened? What was the reason they pulled the offer?
Never do anything without something in writing.
I don't understand why it's frowned upon to not wait. It's at will employment - even if you have the written offer in hand they could rescind that at any time. Why would you need to quit that badly? Because you hate your job that much and do not want to wait a single more day. I got the written offer after I put in my 2 weeks and was fine. If your job is making you that miserable, quit after you get the verbal offer!
It took a little bit longer to get all the approvals than I had anticipated. I ended up with an offer, but it was three months later, and I have a very weird gap in my employment history that includes uber/serving/etc, and I still get questions about it. For the rest of my life it will look like I got fired and scrambled for that other job. If you’re 100% confident that everything is going to go through or that that is the job that you will be in forever and you won’t have to explain any employment gaps if they arise, then sure. Quit. But a verbal offer is not legally binding. Why not wait until you have something in writing? Generally your employment will not be a priority to others. Let it get through the system.
Not a lawyer so I could be wrong, but written offers aren't binding either...I agree written contracts are stronger than verbal contracts though.
In my state, you have to have offer, acceptance, and consideration. A verbal contract does not contain consideration and is not considered binding.
From my understanding and what I've been told, consideration is what each party offers. In a verbal offer, there is consideration. One party offers salary and benefits and the other offers time/employment. This happens in verbal offers and acceptances. Again, not a lawyer so if you are I will trust you. But that's not what I was told by another lawyer.
Promise of consideration isn’t consideration itself. Like you said, each state is different, though!
