I worked with a software MNC for 4 years 6 months 3 days ( 4 years + 185 Days ) . Before leaving I was told by payroll dept. that I am eligible for gratuity. But now they are telling me as my employment is less than 4 years and 190 days , I am not eligible.
Any Suggestions? What actions I can take now ?

How long is too long to try to push back a start date? Getting a formal offer early next week but trying to keep that big law bonus if possible. Firm pays out bonuses Dec 30 & I have a vacation scheduled Dec 19-23 (and was planning on working remotely the week after too). Ideally want to get EOY bonus or negotiate for a signing bonus but is it too much to push for signing bonus and those weeks off? I'm open to working remotely those two weeks but know that may not be the best when I start.

I am an associate at a UMM and my employment contract has a 4 month non compete (yes, even for associates) but I am thinking of lateraling. What are the implications of breaking a non compete? I didn’t say anything when I signed because I was desperate for a PE offer but it seems so unfair as I am just a lowly associate. I am not so much worried about getting sued, but about my current employer tanking my reputation if I leave and break the non compete.
