I currently work for a small boutique defense law firm and have been handling my own plaintiff personal injury case since 2018. I’m looking to change firms to a bigger defense firm. There are about 6 locations in the state. Generally speaking, would a big defense firm allow me to handle this plaintiff case? I really don’t want to have to refer it out since I already put to much time and energy into it.

Most large defense firms would not allow this because it risks pissing off carriers if they found out.

If you like plaintiffs work go to a plaintiffs firm. If you have the ability to get good cases most plaintiff firms will welcome you and give you a good piece of the action.

I hope by your “own” you mean you did it completely on the side from your current firm, or you’ll likely owe them a large portion of your fees for all the time you’ve put into it.

Agree, most won’t allow it for liability risk reasons, possible coverage issues with their malpractice carrier, and politics with their insurance company clients. On that last point, I know of a defense firm partner many years ago that famously lost, literally overnight, a massive book of business defending med mal cases for a large carrier, all based on his public comment criticizing California’s statutory $250k limit on pain and suffering damages in med mal cases. In short, the carrier punished him and his firm (or thought he was secretly pro plaintiff) for his views. Having said that, some large defense firms will handle select plaintiff cases. They may invite the idea of associating in and take a piece, or let you continue on your own but suggest you raise the issue when interviewing and be transparent about everything.

How many married professionals with young families are just sticking it out “for the kids”? Marriage is very dead and has been for a while. Young kids 4 and 1. My wife and I don’t fight, but share 0 interests outside of the kids and can’t stand to be around each other. For anyone who practices tax lit in the US Tax Court, what’s your experience with the independent office of appeals? They don’t seem quite that “independent” to me and so far, I’ve only had one appeals officer who seemed knowledgeable and nice. It’s been a real headache. Interested to hear other people’s experience.

I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. Anyone know a Connecticut or 2nd circuit case for this rule? I can’t find one to save my life. A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..
