I get asked for legal advice often from family / friends. When it’s something legitimate I often offer to help ( I have my own firm / practice) however when it’s BS I’m pulling the oh it’s not my practice area line…. How do you manage the line here?

My firm charges over $500 per hour for my services. I need their permission to take on any work because of ethical rules (i.e. conflicts check). I'm not allowed to do legal work on the side because of insurance.

Its up to your discretion 100% but I guess if it’s something you’re (a) equipped to handle, (b) have the bandwidth to handle, and (c) you desire to handle it, then go for it. If not, offer to recommend someone else or politely decline to assist.

I just dealt with this literally five minutes ago - acquaintance from college sent me an emotional Facebook message asking me about a family law/domestic issue that someone they know is going through. I expressed my sympathy and told them that unfortunately it’s out of my scope and I wouldn’t be able to be of assistance because I’m a corporate and tax attorney and deal with business matters and not interpersonal issues, and then I offered to recommend someone else in my state who may be able to help.

In this particular case I was being completely honest - my focus is M&A, I know close to nothing about family matters and I don’t care to learn. You can’t help everyone and it’s not your responsibility to do so either.

Tell them my billable rate if it’s someone I don’t rly care about 😂

Otherwise, let them know I wouldn’t be able to bc no experience in the field and they would be better off asking an attorney with expertise (use an example of something like asking a Thai food chef to make Russian food)

How do firms calculate how much parental leave to provide, either paid or unpaid. Or do they just pick a number, like “yeah they can get to know their kid in a few weeks and I couldn’t possibly have that attorney out for 12 weeks?” I’m at a small firm, no FMLA or state requirement. We get four weeks paid and four weeks unpaid. Would like to push for more but not sure how to argue costs side of it.

Linguistic question, should an associate say "my partner" when talking to a client about a partner? To me this comes off like implying your also a partner, but saying "our partner" sounds weird too...

Any antitrust experts want to opine on the FB news? I’m certainly no expert, haven’t read the actual complaint, and am all for competition laws, but it does strike me as odd that the FTC is coming in long after the fact to scrutinize certain acquisitions.
