I was notified today that my PERM labor market testing failed 3 months ago. Lawyer wants to add a new requirement to my JD which I don’t meet. I was told that I have to meet that in order to be promoted (currently a SC and the JD is for a manager position) and do the labor testing again. Is it true? Any workaround?

I’m up for a promotion at work and I have no idea how much to ask for since it’s not a standard position. Currently I’m a team lead and manage about 8 technicians, my promotion will be to a regional service delivery manager, and I will be managing over 30 in 3 locations. Just heard my H1B petition was approved. Visa will be valid starting Oct 1, 2021. I am also scheduled to get promoted in October (unsure of which date exactly). But Deloitte sent a notification that they are restarting Perm process. Currently with Deloitte - nothing has been filed. They have the JD and all the documents from my side but haven’t filed pwd yet. Stay or move out .?
