ID associate here. Kind of in the grass is always greener mindset at the moment but also curious - what does an average day look like on the plaintiff side?

That’s going to vary a lot depending on the firm and your role. If I’m busy then I’m in the office 8:30-7:00 and often doing work on weekends. When it’s slow, I’m in the office 9:00-5:00.

Typical stuff: internal calls on the way to the office, informal collaboration in the office, formal meetings in the office, emails, phone calls with adjusters, clients showing up unannounced, putting out a fire (usually a crazy client), litigation review, property damage claims, depositions, mediations, dealing with the full spectrum of defense attorneys (some reasonable and some not, plus there’s always that erratic one with a drinking problem), dealing with staff and their issues.

Plaintiffs work is much more flexible because there is no billable hours, but you gotta get stuff done because no results = no pay. Also there’s a ton of pre-litigation work to do that ID lawyers never have to bother with.

I’ll tell you though, for every one plaintiffs lawyer that is making big money, there are 49 others that are barely scraping by. True numbers might be worse than that. That ID money is at least steady.

What’s with all the internal meetings? What do yall talk about?

I’m in office 9-6, usually do a few hours once I am home to keep up with everything and not fall behind.

Made the switch to PI after being a prosecutor and I am about 8 months in. I have around 35 cases assigned to me. I haven’t done anything too substantial so far it has mostly been responding to discovery and meeting with clients, attending hearings. I’ve taken two depositions. Haven’t done and arbitration or mediation yet. I have a lulls in my day where I am struggling to figure out what to do with. Luckily there are no billables. It’s a little boring and I am kind of in that grass is always greener mindset as well but overall it’s not bad.

Managing clients. This can be a real time sink depending on the type of firm/structure you are in. I used to work at a plaintiff firm where you had to call 25 clients a week, regardless of whether or not there was news to relay. It was terrible.

I can tell you from a paralegal standpoint everything mentioned above is correct. It is a lot of managing clients but there is a lot of money to be made. Seems like the attorneys I work for never realy have to work late or work weekends and we stay on top of our work.

Partners - Do you ever take vacations?

I have been at my current firm for about 1.5 years, and in that entire time the partner in my group hasn't been out of the office a single time. Is that normal? I can't tell if it's standard for big law partners to not take time off, if the dynamics for my group may be different (only 1 partner in the entire group), or it the partner I work with is just a masochist.

What’s a good LA or NY business litigation firm and salary to expect? I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

I have a dumb question... I have my first jury trial coming up in a few months. It's a 3-day auto accident trial. I'm the plaintiff attorney. My question is, should I have my client present the entire three days, or am I okay to tell them that they're fine to leave after they testify?

4th year at a mid size PI firm. I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

Hi everyone - I'm contemplating an offer from a large PI firm. I'm a little more than halfway through completing my 2nd year of practice, and I'm currently at a small firm with a low salary that's just no longer cutting it.

The offer from the large firm is for a pre-suit position, base salary of $100K - is this salary pretty standard for this kind of position?

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.
