Don’t sign anything in the moment and consult with employee-side employment counsel.
Make sure they pay and it's better than whatever your severance would be. Otherwise, do not let them force you to resign
Sorry friend *hug*
Thank you😣
Chief
What is the reason for forced resignation:
Mutual consent?
Restructure?
Elimination of position?
For cause?
Generally speaking as long as it’s not “for cause” you can try to negotiate for more severance, payout of PTO, any bonuses you were eligible for (again if this isn’t a for-cause situation).
If it’s for “mutual consent”, confirm they will not contest unemployment. If it’s for restructure/elimination of position you are also eligible.
Are you eligible to be re-hired for other open positions in the organization for which you are qualified?
Unless it’s explicitly outlined in an employment agreement, companies do not “have” to pay severance. Most places have an algorithm based on years of service (e.g., two weeks of severance per year of employment).
Have an employment lawyer review any document before signing it.
