This is embarrassing to admit but I don’t know how to draft a good subpoena without AI. Like I have no idea how attorneys can come up with 30 different very thorough requests including super technical and correct language. On my own I can think of like, 12 basic requests but AI helps generate requests that I would have never come up with on my own. How to become good at this without relying so heavily on AI?

Law is just about copying what came before… AI just gives you everting at your fingertips.

Previously people “got good” by just looking at a zillion precedents and marking things up accordingly. AI does that for you now.

Think about the arguments you’ll want to make and what you’ll want to support them or the elements they’ll need to prove and how you can undercut them, pay attention to facts in case law, and copy wording from good templates. AI can be a tool that will help you with identifying important elements and offering sample language, but you should be thinking outside of AI too

Agree with C1, everything is recycled from something else, it’s just more automated now. Without AI, it’s just remembering you saw something relevant from X case that you liked and copying that. Repetition and exposure to variety through volume are how people get “good” at such things.

Lots of posts about how it’s all fine as long as you understand what the AI did. But OP acknowledges they can’t do it without the AI.

There’s a difference between writing vs. revising. If you only know how to revise, you don’t really understand it.

I know you’ll all come at me for saying that. I’m not actually a dinosaur. I’m a millennial.

But I really don’t think I’m wrong. I’ve seen it with too many associates. Great on an occasional written assignment, but don’t know how they got there and can’t answer one client question about it on the call.

We’ll be fine for a few years, until there’s no one left to teach the bots.

AI is great for helping me assess redlines on technical topics I’m less familiar on (especially when I’m waiting for specialist counsel to review.)

But it ain’t on the Zoom call with me when I’m negotiating live with opposing counsel (and an audience of our respective clients).

It also isn’t good as assessing risk. And loves to mischaracterize things as backdoor indemnities (and on that point its wrong more often than its right)

Well in the olden days, I would search for 5 sample from past cases and borrow the ones that made sense for me. I don’t recall ever drafting them originally. The new way is the way

This is probably a dumb question because I'm not a litigator. If you can't think of reasons to subpoena someone, then why subpoena them in the first place?

It’s easy, you learn the subject matter. Sure we’ve always relied on copy/paste templates to make it faster, but you need to understand the substance so you know when an ask isn’t needed or when something’s missing.

Ask your AI tool for rationales on why it included the things it did, or to help you create checklists.

AI is a great tool, but don’t outsource your critical thinking!

I’m sure you can do it without AI if you spend enough time, but why spend all that extra time if it’s not necessary? That’s the internal cognitive dissonance that you have to overcome

Second year associate here who recently switched from litigation to corporate law. I am absolutely swamped while simultaneously having no idea what I’m doing ever and I’m feeling so burnt out. The partners are pretty great and feedback is constructive which I’m grateful for, but I’m so desperate for a compliment I’ve been saving any scrap of positivity in a folder 😭 it’s December 22 and I haven’t done my Christmas shopping because I don’t feel capable of thinking about it. I'm a third year plaintiff's employment law attorney and I'm looking to move to defense, preferably still in employment law. I received an offer from a midsize firm that primarily focuses on PI with little-to-no employment law practice, so I'll have a bit of a learning curve. Offer is $90k, billable hours of 2100. Is this reasonable? I'm dead-set on leaving my current job, and this would be a $20k pay increase - which makes me believe I'm leaning towards taking it for those reasons only.
